SEOUL -- While Afghanistan has historically been referred to as the great game among the Great Powers vying for political supremacy in central Asia, a great debate has emerged in the United States over whether the terrorists responsible for the attacks against the World Trade Center and the Pentagon should be tried in a court of law or a military tribunal.
Normally, under the U.S. judicial system, the judge explains what the law is and charges the jury with applying it to the facts. In this case, though, the first thing that must be decided is whether criminal or military law applies.
With the collapse of Taliban regime and the imminent capture of Taliban and al-Qaeda leaders, a decision has become urgent. Before a decision can be made, we first need to agree on the forum best suited to judge the alleged acts -- not the one that best showcases the American judicial system or best holds the antiterrorism coalition together.
