A recently remarried woman who gave birth two months ago has become ensnarled by an outdated Civil Code that says she must register her baby as the child of her ex-husband, who is not biologically related.
The 30-something woman was divorced last March after being separated from her ex-husband for 3 1/2 years. She remarried in September and the couple had a baby in December -- about 50 days earlier than the expected delivery date and about a week too early to save the family from a lot of hassle.
Article 772 of the Civil Code, which took effect in 1898, stipulates that a baby born within 300 days after his or her parents' divorce is presumed to belong to the former husband and is automatically registered under his name.
