Tokyo residents seeking to block Odakyu Electric Railway Co.'s construction of a 6.5-km elevated section of track saw the Tokyo High Court on Thursday overturn a lower court ruling that sided with them.
Even though the Tokyo District Court ruled in the residents' favor on Oct. 3, 2001, by repealing the transport ministry's approval of the plan, Odakyu continued construction on the section, which is slated for completion by month's end.
High court presiding Judge Hideichi Yazaki said Thursday that the 53 current plaintiffs, who owned or lived on adjacent properties, had no right to sue.
