OSAKA -- The Osaka High Court on Tuesday upheld a lower court decision legitimizing a 74-year-old man's claim that radiation from the 1945 U.S. atomic bombing of Hiroshima caused his health problems.
Presiding Judge Takaaki Okabe dismissed the government's appeal against the 1998 lower court ruling, which nullified its decision in 1985 not to recognize the man as a victim of disease caused by the atomic bombing who was eligible for special medical assistance.
The high court ruling follows a Supreme Court decision in July that recognized a woman exposed to the 1945 atomic bombing of Nagasaki as suffering from a radiation-related disease.
